If you are facing your first DUI charge in Connecticut, you may be a candidate for the state's Alcohol Education Program, which if successfully completed, will result in the criminal DUI charge being dismissed.
What is the Alcohol Education Program (AEP)?
The AEP is a diversionary program for first time DUI offenders who have never been convicted of driving under the influence of drugs or alcohol in Connecticut or any other state. Successful completion of the court will result in a dismissal of the charge with no DUI conviction on your record, although your driver history at the DMV will reflect that you completed the AEP program.
You must make application to the court to be considered for Connecticut's AEP program. If you have never been convicted of DUI and have not had the AEP in Connecticut or any other state within the past 10 years, you will likely qualify, although the Adult Probation Department will check your criminal and driver history to verify your eligibility. If you have a prior conviction for DUI you will not qualify, no matter how long ago it was.
Once you complete the program, your case will be dismissed one year after your application was granted. If you do not successfully complete the program, you will be brought back to court and either reinstate you into the program or treat you as a first offender and you will face jail time, fines, probation, and license suspension of one year.
